All Mining is a trademark of Summit Market Ltd. This website is operated by Summit Market Ltd, a company registered under the laws of the Republic of Ireland, whose registered office is at Unit 4a Avonbeg Industrial Estate, Long Mile Road , Dublin 12, D12 C422, Ireland. The terms “we”, “us” and “our” throughout the site refer to Summit Market Ltd. Summit Market Ltd. provides this website, together with all information, tools and services made available to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Please read these Terms of Service carefully before accessing or using our website or engaging in any transaction with All Mining. By accessing any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. Acceptance is expressly limited to these Terms of Service if these Terms of Service are considered an offer. We also recommend that you read our Warranty Policy, Cookie/Privacy Policy, Refund Policy, FAQ and Shipping Policy.

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

CHANGES TO SERVICE AND PRICING

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or to any third-party for any modification, price change, hashrate adjustment, suspension or discontinuance of the Service.

ACCURACY OF BILLING INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

ORDER PROCESSING

Order processing will only begin once we have received a confirmed order and full payment including taxes, shipping, customs duties and insurance (if applicable). All Mining reserves the right to change prices at any time without notice. Due to the volatility of cryptocurrency prices, orders are only valid for a certain period of time. Due to the high demand for ASIC miners, All Mining can only reserve a unit for a customer once payment is received, not when an order is placed online.

We inform you that the payment is made and a proof of payment is sent to us within 24 hours of your order. Once the payment is made, please send a copy of your transfer receipt to: hello@allmining.io .

PARTNERSHIPS WITH MINING FARMS

The mining farms offered by All Mining are the facilities of our partners. All Mining neither owns nor rents these facilities. Our role is limited to putting you in touch with mining farms that meet your selection criteria.

We do not control the activities of mining farms, and therefore All Mining is not responsible for their management or any incident that may occur during the operation of these farms. In the event of a problem, it is the customer's responsibility to manage the relationship with the mining farm concerned directly. However, our team remains available to provide advice or assistance if necessary.

PAYMENT OPTIONS AND PRICES

All Mining aims to offer the most competitive prices on current products; the total price of your order will include the purchase price plus any applicable sales tax and shipping charges (on the day of shipment). Payments can be made via bank deposit/wire transfer or cryptocurrency. We cannot ship any products until funds have cleared.

Direct deposit

You can pay for your products via direct deposit. You will need to go to your bank and physically make your direct deposit there. Please send us your deposit slip at hello@allmining.io to ensure your payment is confirmed and your order is shipped as quickly as possible.

As we are a company registered in Ireland, we prefer payments to be made in EUR via bank transfer (online or direct bank deposit) or cryptocurrency transfer.

Cryptocurrency payment

Payment Terms. Accepted payment methods include bank transfer and cryptocurrency. All Mining may change the acceptable payment methods from time to time.

The amount of cryptocurrency that matches the total balance of your placed order will be provided at checkout using the real-time exchange rate of that cryptocurrency to EUR or USD. All Coinbase wallet transactions are processed on the blockchain, which means senders will be charged a miner/transfer fee.

All payments made in cryptocurrency will be converted to stablecoins (such as USDT, USDC, or another stablecoin) immediately upon receipt to mitigate the risk of price volatility. This conversion process ensures that the value of your payment remains stable and there is no discrepancy between the amount paid and the amount owed.

Please note that All Mining is not responsible for fluctuations in the value of cryptocurrency between the time payment is made and the time it is received. By making a payment in cryptocurrency, you acknowledge and agree that the final amount received by All Mining, after conversion to stablecoins, will be the amount credited for your order. If there is a significant decrease in the value of the cryptocurrency between the time it is sent and the time it is received, any shortfall will be the responsibility of the customer.

Please note that some asset issuers may send or “parachute” cryptocurrencies to your wallet, even though you will not have the ability to withdraw them. This is called a “frozen drop.” Please contact the asset issuer directly for guidance on how to move these assets. Assets cannot be moved unless they are returned to the sponsored exchange. Additionally, please note that an asset may start as an ERC-20 and then move to its own blockchain, which may or may not be supported.

SHIPPING POLICY

Please note, we can only process an order for dispatch once full payment has been received. We aim to arrange dispatch of all in-stock units within 7 working days of receipt of payment. Once the order has been dispatched, it will typically take 5-10 working days to arrive from the courier company. All later release units must first be posted and received from the manufacturer before they can be classified as in-stock.

Depending on your shipping address and product availability, your order may arrive in multiple shipments or be sent directly from our shipping facilities in China, Hong Kong, or the United States (if ordered from US-based inventory). All units shipped to Europe will be shipped from China or Hong Kong, where the miners are produced.

Any shipping or delivery dates provided are estimates only and we cannot be held responsible for any delays by courier companies or manufacturers.

When you receive your shipment, please inspect all packages for items such as power supplies, manuals, or any accessories applicable to the product(s) ordered. Be sure to save the box, outer shipping carton (if applicable), and all packing materials, in the unlikely event you need them for a return shipment. Any damage in transit must be handled by the customer directly with the carrier. The carrier may request to inspect the item upon receipt of a claim.

Additional costs expected

Purchasing a suitable power cable: All ASIC miners sold by All Mining come with original/Chinese power plug cables only. As these cables are not suitable for use in the rest of the world, the manufacturer often does not include them when marketing the units for shipping outside of China. See our FAQ page for more details.

Customs clearance fees for orders shipped to destinations outside Europe: All orders sold and delivered by All Mining within Europe are inclusive of value added tax. All international orders sold and delivered by All Mining outside Europe are exclusive of value added tax. We are not responsible for any duties, taxes or fees that may be incurred by the customer. It is the customer's responsibility to be aware of local duties and tax laws and to manage any customs issues that may arise. All Mining will not be responsible for any damage costs or expenses resulting from errors in the calculation of taxes and duties relating to your order.

Undelivered Packages: Occasionally, packages are returned to us undelivered. If this happens, we will do our best to contact you to make arrangements for reshipment. The recipient will be responsible for the return shipping costs, resending the package, and any storage costs.

Upon delivery of the products to the carrier, our delivery will be deemed complete, and title and risk of damage to and loss of the products will pass to you. This includes any shipping charges and Chinese import tax. We do not accept any refund requests for failed customs clearance.

MINING SAFETY

TO DO:

  1. Inspect the miner for any cosmetic damage or loose heat sinks. If you notice any damage or defects, or find any loose heat sinks, contact us immediately.

  2. Install the miner in a dust-free environment with unobstructed air circulation.

  3. Discharge static electricity or wear anti-static PPE during miner installation or maintenance.

  4. Unplug the miner when installing or maintaining it. Otherwise, the control board will be damaged.

  5. Use a power supply that can provide 20% higher output power than the miner's required power. When the actual output of the power supply does not meet the miners' power needs, the hash rate will be low.

  6. Correctly connect the positive ports and negative ports of the 6-pin D/C power connectors of the PSU to the control board and hash boards of the miner.

  7. Use one PSU for one miner. The miner can receive power from different PSUs, but each hash board can only receive power from one PSU. The 6-pin power connectors are interchangeable, so the sequence does not matter when connecting the connectors to the miner.

  8. Power the hash boards first, then power the control board. If you power a miner with a single PSU, you can turn it on immediately after connecting the hash boards and the control board.

  9. Make sure the miner is properly grounded.

  10. Install lightning protection; otherwise, all equipment could be damaged if struck by lightning.

  11. Antminers can only be connected via Ethernet cable and do not support Wi-Fi connection.

  12. In case of internet connection or network failure, if it can be restored within 15 minutes, miners do not need to be unplugged and restarted. If the failure cannot be repaired within a short time, turn off the miner. An unstable internet connection will cause the miner to crash. Different routers have different settings, consult your router provider to find out how many miners can be connected to your router. An internet speed of 1 Mbps can support up to 150 miners.

  13. A minor uses about 500 MB of internet connection per month. Be prepared to use enough data if you use a data card.

  14. Use supported browsers: Google Chrome and Firefox.

  15. Clean and dust the miner periodically. When the airways in front of the heat sinks are blocked, the miner will be affected.

DON’T:

  1. Do not use the miner in an enclosed or confined area. Any object blocking the airflow of the miner is prohibited.

  2. Do not use or place the miner in an environment where there is heavy condensation or high levels of salt content and humidity in the air. The recommended humidity is less than 65%. Coastal areas are subject to high air salinity, which can easily damage the hash board.

  3. Do not use the miner in extreme temperatures. It is recommended that the working environment temperature be between 5 and 35 degrees Celsius. At low ambient temperatures, the hash rate will be low. At high temperatures for a long time, the miner will malfunction.

  4. Do not use water curtain (for cooling) in a situation where a large amount of dust accumulates, the water vapor will adhere to the dust accumulation area and corrode the chopping boards.

  5. Using PoE function switches or routers is not allowed as the control board would be burned.

  6. Do not touch the connectors on the control boards and the fan, as they are directly connected to the pins on the IC. Touching these connectors in the absence of electrostatic discharge will damage the IC, causing the miner to malfunction.

  7. Do not attempt to use a miner that appears damaged.

  8. Never use multiple power supplies to power a single hash board.

ANTMINER REPAIR DISCLAIMER

All Mining is not responsible for any decision made by any of our product manufacturers to scrap or refuse repairs on a miner or its components. You, the customer, acknowledge that you fully understand the risks associated with this repair process and that All Mining is 100% indemnified and cannot be held responsible for any loss or damage caused by any means during the shipping or repair process.

The turnaround time is dictated by the manufacturer of each miner and not All Mining. We will communicate with you regarding the process.

The fees associated with this transaction cover the following:

  • Courier charges from manufacturer to you, the buyer.

  • Technical report and analysis by an All Mining technician before sending the miner.

  • Transaction fees charged by I-Pay and/or Virtual Card Services.

  • SARS Repair and Return Directive

  • Repair ticket process and tracking.

  • Administration costs for the entire process.

  • Test of the returned machine with technical report.

  • Return from minor to customer

NB: If a miner has been repaired and returned by a manufacturer to All Mining or yourself and it has been damaged in transit, we cannot be held responsible and will endeavour to pursue a remedy with the manufacturer, but the customer may be required to pay the associated costs again of returning the miner for a second time. This is a risk and please ensure you understand this risk before entering into this transaction.

Any repairs carried out, if not paid for, will result in the items being scrapped. All Mining pays on your behalf and if you fail to pay for the repairs, All Mining reserves the right to sell the entire unit to recoup the costs and All Mining will not be held liable for any damage or loss.

For all returns, customers must use a courier service that offers:

  • Tracking shipments and;

  • Ensure the safe return of your package and declare the full value of the shipment, failing which any loss or damage will be your responsibility.

USER COMMENTS AND FEEDBACK

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

You acknowledge and agree that we are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content (including misleading or defamatory content) of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on such external sites or resources.

WARRANTY DISCLAIMER: LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall All Mining, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages. , or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

All Mining will not be liable for any loss, damage or interruption of service resulting from the actions or omissions of partner mining farms. Any claims or disputes relating to hosting services should be handled directly with the relevant mining farm. By accepting these terms, you acknowledge and agree that All Mining will not be liable for any direct, indirect, consequential or special damages resulting from the use of hosting services provided by our partners.

APPLICABLE LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of Ireland.

OUR RIGHTS AS A COMPANY

We reserve the right to:

  • Modify or withdraw, temporarily or permanently, the Website (or any part of it) with or without notice, and you confirm that we will not be liable to you or any third party for any modification or withdrawal of the Website.

  • Change these Terms from time to time, and your continued use of the Website (or any part thereof) after any such change will be deemed to be your acceptance of such change. It is your responsibility to check the Terms regularly for changes. If you do not agree to any changes to the Terms, you must immediately stop using the Website.

  • Block access to the site or prevent specific users from viewing our site.

  • Refuse to refund any product or service shipped or ordered on behalf of a customer, as the same arrangement is in place with our suppliers. All Mining does not offer refunds, only warranty repairs/exchanges on defective parts.

We will use our reasonable endeavours to maintain the Website. The Website is subject to change from time to time. You will not be entitled to any compensation because you are unable to use any part of the Website or because of any failure, suspension or withdrawal of all or any part of the Website due to circumstances beyond our control.

MONITORING

We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Terms or complaints and take any action we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or assigning conditions to your access and/or removing any material from the Website).

UPDATING THESE TERMS AND CONDITIONS

We reserve the right to change, modify, add or remove parts or all of these terms and conditions from time to time. Changes to these terms and conditions will be effective immediately upon posting such changes on this Website. It is the User's obligation to periodically check these terms and conditions on the Website for changes or updates. The User's continued use of this Website after any changes or updates are posted will be deemed to be notice of the User's agreement to abide by and be bound by these terms and conditions, including such changes or updates.

CONSENT

I understand that all trademarks and designs are registered with All Mining and I hereby agree to the terms and conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in any way and understand the legal implications thereof. If I am found to be in breach of this agreement, I understand that I will be held liable for all legal costs incurred by All Mining for any civil action or legal action deemed necessary against me.

DISPUTE

In the event of a dispute, the Parties undertake to find an amicable solution to the dispute within thirty (30) days. In this respect, the Beneficiary is invited to send his complaint to All Mining in writing to the following address: bonjour@summit.io . Furthermore, in accordance with Article L.612-1 of the Consumer Code, the Beneficiary, a natural or legal person in his capacity as Consumer, has the possibility of resorting to conventional mediation, in particular with the Mediation and Consumer Commission. Also, in the absence of an amicable settlement of the dispute, the Beneficiary may refer the matter to the Consumer Mediator. If the file is admissible, the dispute will be handled by the Consumer Mediator. In the event of failure of amicable settlement and mediation, Article L.141-4 of the Consumer Code provides that " the consumer may, at his choice, refer the matter to one of the courts with territorial jurisdiction under the civil procedure of the Consumer Code, the jurisdiction of the place where he resided at the time of the conclusion of the contract or the occurrence of the harmful event. "

 

CLASS ACTION WAIVER

Any dispute resolution proceeding must be brought in the parties’ individual capacities, and not as a plaintiff or class member in any purported class, collective, representative, multiple-plaintiff or similar action (“Class Action”). The parties expressly waive any ability to maintain a class action in any forum. Unless the parties later agree otherwise, the arbitrator will not have the authority to combine or consolidate similar claims or conduct a class action, or to award any award to any person or entity not a party to the arbitration. Any claim that all or any part of this class action waiver is unenforceable, unconscionable, void or voidable may be resolved only by a court of competent jurisdiction and not by an arbitrator. The parties understand that they would have had the right to litigate in court, have a judge or jury decide their case, and be a party to a class or representative action; However, the parties understand that they are waiving these rights and elect to resolve any dispute individually, through arbitration.
